General Terms and Conditions

§ 1 Scope

These General Terms and Conditions apply to all contracts for the sale of goods concluded via the pizza and goods vending machine operated by Pizza24 Schönberg, Musterstraße 1, 24217 Schönberg (hereinafter "Operator").

§ 2 Conclusion of contract

The presentation of goods at the machine constitutes a binding offer by the Operator to conclude a purchase contract. The purchase contract is concluded when the customer selects the desired goods, pays the purchase price in full and the goods are dispensed by the machine.

§ 3 Prices and payment

The prices displayed at the machine at the time of ordering apply. All prices include statutory VAT. Payment is made directly at the machine using the payment methods offered there (e.g. cash, debit or credit card, contactless payment).

§ 4 Dispensing and availability

The goods are dispensed immediately after successful payment. The range of goods depends on the respective stock of the machine. There is no entitlement to the constant availability of individual products.

§ 5 Machine malfunctions

If, after payment has been made, the goods are not dispensed (e.g. due to a technical malfunction), the customer will be refunded the amount paid or offered a replacement. § 6 Consumer information on food

Information on ingredients, allergens and additives of the food offered is provided at the machine or on the product packaging. Please observe the relevant notices before consumption. The food offered is intended for prompt consumption.

§ 7 Right of withdrawal

Pursuant to § 312g(2) of the German Civil Code, a right of withdrawal does not exist, among other things, for contracts for the supply of goods that can spoil quickly or whose expiry date would quickly be exceeded, as well as for sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. Moreover, as the sale takes place on site at the machine, there is no statutory right of withdrawal as in distance selling.

§ 8 Warranty

The statutory warranty rights apply. Obvious defects in the goods must be reported to the Operator without delay using the contact details above.

§ 9 Liability

The Operator is fully liable for damage arising from injury to life, body or health as well as for damage based on intent or gross negligence. Otherwise, liability is limited to the foreseeable damage typical of the contract.

§ 10 Final provisions

The law of the Federal Republic of Germany applies. Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
